The Allahabad High Court has ordered the demolition of Towers 27 and 28, together with the ninth and tenth floors of Towers 16, 17, 18 and 19, at Gulmohar Greens residential society in Ghaziabad.
The judgment, delivered on 27 October 2026, gives the Ghaziabad Development Authority (GDA) two months to carry out the demolition. It sets aside the third compounding approval, dated 18 December 2024, under which the disputed construction had been approved.
The order concerns specified structures. It is not a direction to demolish the entire residential society.
Why the Approval Was Set Aside
The case centres on alterations to the housing layout and whether the disputed construction could lawfully be approved through compounding.
Compounding provides a mechanism for dealing with eligible deviations under applicable rules. It does not make every addition permissible merely because an authority accepts it.
Bar & Bench reports that the court found the disputed additions were not compoundable. The court also examined failures concerning prior permissions, apartment-owner consent, common areas and completion certification.
The judgment is available here -> Suresh Chander and 10 others v. State of U.P. and 2 others.
An Important Distinction for Residents
The court recorded that apartments constructed under the third compounding had not been sold and that no third-party interests had been created in them.
It treated earlier construction differently. Although it recorded illegalities in the first and second compounding approvals, it declined to pass adverse orders concerning those apartments in the particular circumstances, including existing third-party interests and the scope of the challenge.
This distinction matters when assessing reports about the society. A demolition headline cannot establish the legal position of every home within it.
Directions Extend Beyond Demolition
The court imposed ₹25 lakh in costs on the promoter, payable to the residents’ welfare association. It also directed GDA to pay ₹50,000 to each petitioner in the 2025 writ petition.
Other directions include registration of an FIR against the promoter and a disciplinary inquiry concerning the official who approved the third compounding.
A direction to register an FIR is not a criminal conviction. The judgment’s findings and any subsequent criminal proceedings must be distinguished.
An Appeal Is Reported, but a Stay Is Not Established
Dainik Jagran quoted GDA secretary Vivek Mishra as saying the authority would approach the Supreme Court through a special leave petition.
That statement describes an intended legal step. The sources reviewed did not establish a subsequent stay, completed demolition or compliance with the financial directions.
The next developments to watch are any filed challenge, subsequent judicial orders and GDA’s implementation notices.
We examined the importance of matching approvals to individual properties in a separate case -> Noida Sports City: Four Projects Get Conditional OCs. The legal circumstances differ, but both require attention to the precise coverage of each document.
