Haryana RERA warns Gurgaon buyers against unregistered property projects

Haryana Real Estate Regulatory Authority (HRera) has warned homebuyers against booking or purchasing plots, flats, villas, apartments and other units in unregistered real estate projects, saying such transactions can attract legal action and leave buyers without the regulatory protection available under the RERA Act.
In a public advisory reported by The Times of India, HRera asked prospective buyers to conduct due diligence before making an investment. Buyers should verify a project's RERA registration certificate and number, website, approved site address and other relevant details through the authority's portal.
The warning comes as Gurgaon continues to see substantial real estate development. According to HRera data cited by The Times of India, the Gurgaon authority approved 131 projects in 2025 involving investments of Rs 86,588 crore and 35,455 units. Residential projects accounted for 31,455 of those units. Twenty-eight projects accounted for Rs 59,360 crore of the total investment.
HRera said buyers could be approached with pre-launch schemes, promotional offers or booking opportunities before projects receive the required approvals and RERA registration. The authority has also taken note of advertisements for projects that had not received the necessary approvals.
The regulator directed promoters not to issue pre-launch advertisements, marketing material or promotional offers for such projects. It said the sale, marketing, booking or purchase of units in an unregistered project violates the Real Estate (Regulation and Development) Act, 2016.
The warning also covers property agents. Under Section 9 of the RERA Act, an agent facilitating the sale or purchase of units in a registered project must obtain registration with the authority. HRera said transactions facilitated by unregistered agents could also attract legal consequences.
Section 59(2) of the Act makes advertising, marketing, booking, selling or offering for sale units in an unregistered project a punishable offence, according to HRera's advisory. The authority said it can initiate legal and regulatory action against promoters, agents or others found violating the Act.
HRera had issued a similar advisory in January, asking homebuyers and property investors to deal only with registered property agents and warning about the legal and financial risks associated with unregistered intermediaries.
For buyers, the immediate takeaway is to check the project's registration number and approved details on HRera's official database before making any payment or signing an agreement. A booking offer or promotional campaign should not be treated as proof that a project is legally ready for sale, the authority said.
