Hundreds of Jubilee Hills properties face transaction restrictions over 22-A list

Hundreds of properties in Hyderabad’s upscale Jubilee Hills have been included in the government’s prohibited properties list, restricting owners from selling, transferring or mortgaging their properties, according to an ETRealty report citing The Times of India.

The properties have been listed under Section 22-A of the Registration Act, which restricts transactions involving specified properties. The Jubilee Hills properties have reportedly been identified as government ceiling land. Owners seeking to transact have been asked to obtain a No Objection Certificate (NOC) from the Hyderabad district collector confirming that their land is neither government-owned nor ceiling land.

The issue affects properties in survey numbers 403/1, 120 and 102/1. A property owner told The Times of India that a sub-registrar office informed him that his property near Road No. 36, close to the residence of Telangana Chief Minister A Revanth Reddy, was included in the 22-A list.

The situation has also raised concerns over the transparency of the prohibited-property records. According to the report, the Hyderabad district’s revised 22-A list is not available on the Registration and Stamps Department’s website. Property owners approaching sub-registrar offices are instead being given information about the status of their properties.

Other districts had reportedly submitted revised 22-A lists to the department after making additions and removals, but Hyderabad district had not submitted its revised list or published it online, according to the report.

The dispute is particularly significant for properties associated with the Jubilee Hills Cooperative House Building Society (JHCHBS). The society was allotted 1,398 acres by the government, with parts subsequently allotted to other societies, hospitals and educational institutions during the 1970s and 1980s.

The society has around 3,035 plots spread across roughly 1,100 acres in survey numbers 403/A, 120 and 102/1, and has about 5,000 members, the report said. Survey numbers 403/1 and 120 are located in Shaikpet village, covering Jubilee Hills, while part of survey number 102/1 falls in Hakimpet village, covering Banjara Hills.

A representative of the Jubilee Hills society told The Times of India that plots were generally allotted at sizes ranging from 1,200 to 1,500 square yards, with some members later acquiring adjoining plots. According to the representative, properties exceeding 1,200 square yards are among those facing the issue because of land-ceiling rules.

The representative also said some owners had added land to their original allotments and regularised those additions through the society. Those properties, too, are facing restrictions, according to the report. The society estimates that around 300 plots, or about 10% of its total plots, are affected.

Shaikpet tahsildar Y Anitha Reddy told The Times of India that the 22-A list was under revision. She also confirmed that certain survey numbers in Jubilee Hills and other parcels in Shaikpet mandal were under prohibition because the government had claims over the land.

For affected homeowners, the immediate concern is whether they can establish clear title and obtain the required government clearance before carrying out a property transaction. Until the prohibited list is revised or the required NOC is secured, properties on the list can face significant hurdles in registration and transfer.
